2020

WGN-TV Chicago, August 21, 2020: Toxic emissions lawsuits against Sterigenics skyrocket from 75 cases to more than 700.

Attorney Antonio Romanucci of Romanucci & Blandin, LLC speaks with WGN-TV following the filing of more than 600 additional individual lawsuits for cancers, miscarriages and other health problems caused by emissions of the airborne carcinogen ethylene oxide (EtO) from the Sterigenics facility in Willowbrook, Illinois. The newly-filed victims’ cases bring the current number of individual cases pending in Cook County, Illinois to more than 700. The cases are filed on behalf of people who lived and worked near the Sterigenics medical sterilization facility which permanently closed in Fall of 2019. The cases state Sterigenics and others are responsible for causing leukemia, lymphoma, breast cancers, various other cancers, miscarriages, and other medical conditions that severely changed or ended the lives of so many in that community. For the initial approximately 75 filings, Antonio M. Romanucci is the court-appointed Lead Counsel for the legal group suing Sterigenics.

R&B Cases & Concepts, August 6, 2020: ComEd – Human Cost of Corruption

In this episode of “Cases and Concepts”, Romanucci & Blandin founding partner Stephan Blandin shares the heartbreaking story of a family whose lives were forever changed when a faulty Commonwealth Edison (ComEd) electrical pole that was not properly maintained caused a catastrophic electrocution of two innocent individuals who were trying to work and earn an honest living. In 2016, 32-year-old Robert Zulauf and his nephew 23-year-old Jordan Zulauf were working on a ComEd pole in Sterling, Illinois when they were electrocuted. Robert was burned so badly he lost his life, and Jordan lost both of his arms. For years, our firm has been fighting to find out why state regulators didn’t investigate this deadly electrocution by a ComEd wire that had been out of code for decades. Blandin, who represents Robert’s estate and his wife, is now calling on ComEd to come clean on its behavior, where for decades it has not lived up to its responsibility to provide the safe transmission of power to the people of our state. Furthermore, Blandin is calling for an official audit of ComEd’s relationship with the Illiniois Commerce Commission and of safety and inspection records for thousands of ComEd poles across Illinois. ComEd’s history of corruption and self-serving conduct has manifested itself in willful violation of the Public Utilities Act, as maintenance of thousands of electrical poles across the state has been ignored – in this case for over 48 years. Furthermore, ComEd’s agreement to pay $200 million dollars following a federal investigation into bribery of Illinois high level government officials begs more questions about how ComEd’s corrupt practices may have contributed to this family’s tragedy.

R&B Cases & Concepts, July 29, 2020: The Public Health Crisis of JUUL

In this episode of “Cases and Concepts”, Romanucci & Blandin founding partner Antonio Romanucci discusses the public health crisis facing America’s youth – the use of e-cigarettes, primarily by the manufacturer Juul. Juul has become extremely profitable over the last several years by taking pages from the Big Tobacco marketing playbook, successfully making young people addicted to nicotine and lifetime customers of their products. In 2019, R&B client Adam Hergenreder suddenly became incredibly ill and was hospitalized with life threatening respiratory problems after Juul’ing for many months. This former varsity athlete now suffers from shortness of breath and has been told that vaping may cause him permanent, life changing health consequences. Adam has devoted himself to educating others on the dangers of Juul’ing and has testified to Illinois lawmakers asking for tighter regulation on these products. R&B is fighting on behalf of Adam and others to ensure that Juul is unable to put profits over people. We have a responsibility to the next generation of our youth and will make sure we continue this educational program to ensure their safety.

WTTW-TV Chicago, July 28, 2020: R&B Attorney Stephan Blandin Discusses Class-Action Lawsuit Against ComEd with WTTW Chicago Tonight.

Romanucci & Blandin founding partner Stephan Blandin addresses whether Commonwealth Edison (ComEd) customers could get reimbursed for ‘wrongfully inflated rates’ on WTTW’s Chicago Tonight program following the filing of a class-action lawsuit against ComEd on behalf of consumers and businesses. ComEd has to pay a $200 million fine to the federal government as part of its deal with the U.S. attorney’s office after its admission that some of its top executives actively engaged in bribery to help get favorable legislation passed through Springfield, including a pair of laws that paved the path for rate increases. According to the deferred prosecution agreement, ComEd benefited by at least $150 million through the scheme. Blandin discusses how the attorneys want to find out what the full extent of their profits were as a result of this admitted bribery scheme and to make sure that that gets refunded to the ratepayers. The class-action lawsuit was filed on July 27, 2020 by Romanucci & Blandin, LLC and DiCello Levitt Gutzler LLC.

Press Conference, July 28, 2020: Romanucci & Blandin and DiCello Levitt Gutzler together Announce the Filing of a Class-Action Lawsuit against ComEd by Consumers and Businesses.

Video playback of July 28, 2020 press conference announcing the filing of a class-action lawsuit against Commonwealth Edision (ComEd) on behalf of consumers and businesses. Romanucci & Blandin, LLC and DiCello Levitt Gutzler LLC together announced the filing alleging that ComEd violated the Illinois Consumer Fraud Act and unjustly enriched itself by overcharging its 4 million customers in Illinois for years. The recent $200M ComEd agreement to pay the government following a federal bribery investigation does nothing to compensate the individuals and businesses who actually overpaid. The lawsuit was filed on July 27, 2020, in the Circuit Court of Cook County, Chancery Division. The class-action suit seeks to represent a large percentage of ComEd customers during the period of time established by prosecutors.

WGN-TV Chicago, July 20, 2020: West Chicago Family Sues ComEd and Demands Accountability Following Tragedy in 2016.

Members of the Zulauf family speak with WGN Chicago demanding answers about how Commonwealth Edison’s (ComEd) corrupt practices may have contributed to the death of 32-year-old Robert Zulauf and the severe injury to his nephew 23-year-old Jordan Zulauf. The two were working on a ComEd pole in Sterling, Illinois on November 8, 2016 when they were electrocuted. As a result, Robert Zulauf was burned so badly he lost his life and Jordan lost both of his arms. Romanucci & Blandin founding partner Stephan Blandin shares how the line the men were working on was not properly insulated and had remained that way for nearly 50 years. Furthermore, the Illinois Commerce Commission which has a mandate to oversee ComEd, never cited them for a violation following the deadly incident.

Press Conference, July 20, 2020: Romanucci & Blandin and Wise Morrissey Call for a Full Audit of Commonwealth Edison and its Relationship with the Illinois Commerce Commission.

Video playback of July 20, 2020 press conference calling for a full audit of Commonwealth Edison (ComEd) and its relationship with the Illinois Commerce Commission along with ComEd’s maintenance records of nearly one million electrical poles across Illinois. Romanucci & Blandin founding partner Stephan Blandin and Wise Morrissey attorney Bob Bingle called for this accountability because their clients were killed or permanently injured because of a faulty ComEd electrical pole that was not properly maintained and caused a catastrophic electrocution of two innocent individuals who were trying to work and earn an honest living. On Friday, July 17, 2020 U.S. Attorneys announced that ComEd agreed to pay $200 million dollars following a federal investigation into bribery of Illinois high level government officials. Members of the Zulauf family want answers about how ComEd’s corrupt practices may have contributed to the death of 32-year-old Robert Zulauf and the severe injury to his nephew 23-year-old Jordan Zulauf. The two were working on a ComEd pole in Sterling, Illinois on November 8, 2016 when they were electrocuted. The line was not properly insulated. Robert Zulauf was burned so badly he lost his life. Jordan lost both of his arms. The Zulauf family has filed a civil complaint against ComEd.

Press Conference, July 15, 2020: Press Conference Announcing the Filing of a Civil Lawsuit on Behalf of George Floyd’s Family.

Video playback of July 15, 2020 press conference in Minneapolis, MN announcing the filing of a civil lawsuit against the City of Minneapolis and the four officers involved in Mr. Floyd’s death. Civil rights attorney Ben Crump, Romanucci & Blandin founding partner Antonio Romanucci, attorney L. Chris Stewart and other co-counsel on behalf of the family of George Floyd shared details of the filed complaint while emphasizing that Mr. Floyd died because the weight of the entire Minneapolis Police Department was on his neck. Furthermore, the attorneys highlighted the City of Minneapolis’ history of policies, procedures and deliberate indifference that has violated the rights of arrestees, particularly Black men, and the need for officer training and discipline. With this lawsuit, the legal team and family of Mr. Floyd seek to set a precedent that makes it financially prohibitive for police to wrongfully kill marginalized people — especially Black people — in the future. The federal lawsuit was filed in the United States District Court for the District of Minnesota. The plaintiff is Minnesota attorney Kaarin Nelson Schaffer, who was named trustee for the Floyd family on July 6, 2020.

R&B Cases & Concepts, July 7, 2020: Failure to Diagnose Breast Cancer.
In this episode of “Cases and Concepts”, Romanucci & Blandin founding partner Stephan Blandin discusses the tragic loss of a 37-year-old mother of three young girls after her doctors failed to diagnose her breast cancer in a timely manner. We live in a time where having an increasingly competitive and volume-driven healthcare market is the normal. The pressure physicians face to see as many patients as possible is very real – and so is their financial incentive. Our client was a high-risk breast cancer patient with a family history and a sister with breast cancer. The lumps in her left breast and armpit were ignored for two years as the treating health system and specialists misread ultrasounds and mammograms, failed to order timely biopsies and failed to communicate with each other, resulting in late stage breast cancer when it was finally diagnosed in 2014. She died in 2016. In this scenario, the hospital was penny wise and pound foolish, taking a wait and see approach instead of spending the money on certain tests. Anyone with a breast lump needs a needle biopsy to rule out cancer. The irony in this case is that the expense they saved on not performing the biopsy, lead to a $12.35 million settlement cost to the physicians and hospital. Our client’s tragedy could have been avoided if the OB/GYN, radiologists, and surgeon worked as a team, picked up the phone and discussed our client’s numerous red flags. Until meaningful change is made within our healthcare systems, patients must advocate for themselves so they do not fall through the cracks.

R&B Cases & Concepts, June 30, 2020: The Danger and Ethics of Police Chases.
In this episode of “Cases and Concepts”, Romanucci & Blandin founding partner Antonio Romanucci discusses the danger and ethics of police chases and the tragedy experienced by our clients, the Carreon family. While Hollywood has worked hard to “glamorize” police chases on TV and in films, making them seem fun, energizing and exciting, we know that the opposite is true. Police chases can have catastrophic consequences and even be deadly. In fact, the number of police chase fatalities has been up year over year since 2015. In April 2019, the Carreon family was awarded $21.3 million after a jury found that the City of Chicago and Chicago Police Department officers showed an utter indifference to or conscious disregard for their own safety and the safety of others, particularly the Carreon family, when the officers initiated and engaged in a police pursuit of a vehicle which they believed to be stolen back in 2015. This disregard led to the loss of a mother of five and lifelong injuries for her family members.

R&B Virtual Town Hall, June 8, 2020: Attorneys Address Dam Failures and Flooding in Mid-Michigan.
The devastating flooding in mid-Michigan during May of 2020 was NO accident, and should have been prevented. There were warning signs for years about trouble with the aging dams. Romanucci & Blandin, LLC and Ven Johnson Law, PLC co-hosted a virtual town hall to discuss the dam failures and flooding. Topics included the benefit of a mass tort, preserving evidence of damage and losses, working with insurance companies, available government assistance and a Q&A session.

Chicago-based Attorney Antonio Romanucci serves alongside lead counsel, Ben Crump as co-counsel on the legal team for George Floyd’s family. CNN, June 1, 2020: Attorney Antonio Romanucci discusses George Floyd Autopsy on CNN Out Front.
Co-counsel on the legal team for George Floyd’s family, Antonio Romanucci of Romanucci & Blandin LLC joins Erin Burnett on CNN Out Front to discuss results from the independent medical examiners who conducted an autopsy of Mr. Floyd. World renowned medical examiner Dr. Michael Baden and Dr. Allecia Wilson found the manner of Mr. Floyd’s death was homicide caused by asphyxia due to neck and back compression that led to a lack of blood flow to the brain. Sustained pressure on the right side of Mr. Floyd’s carotid artery impeded blood flow to the brain, and weight on his back impeded his ability to breathe. The independent examiners found that weight on the back, handcuffs and positioning were contributory factors because they impaired the ability of Mr. Floyd’s diaphragm to function. The legal team, which includes Ben Crump Law as lead counsel, Romanucci & Blandin LLC, Newmark Storms Dworak, Pintas and Mullins, and Jacob Litigation, last week filed a petition to bring a wrongful death lawsuit.

Attorney Ben Crump, co-counsels, and the family of George Floyd called for the arrest of all the officers who played a part in Floyd’s death and for a first-degree murder charge to be brought against Derek Chauvin, after independent medical examiners who conducted an autopsy of Floyd Sunday determined that asphyxiation from sustained pressure was the cause of death. From all the evidence, the doctors said it now appears Mr. Floyd died at the scene.

We are all now acutely aware that the COVID-19 crisis is taking a tremendous toll on all of our lives, but nowhere is that more evident than in the restaurant industry. The essence of restaurants, of course, is in the connection to other people – the dining room atmosphere, interaction with wait staff and delicious meals prepared by skilled chefs. However, with non-essential business closed to slow the spread of the virus, the restaurant and foodservice industry has been tragically impacted. In response, Romanucci & Blandin is proudly supporting and asking others who can to support the important work being done by Frontline Foods Chicago and World Central Kitchen. These organizations are directly helping restaurants and keeping them working by making meals, which are given to healthcare workers and community members in need. Please watch our brief video to learn more about these initiatives and how you can help.

The plaintiffs are the owners of Maillard Tavern and the defendant is Society Insurance, to which the restaurant owner made contractual premium payments, expecting compensation during their time of need, according to the policy written by Society Insurance. The lawsuit is seeking a declaratory judgement from the court, meaning a decision that finds the insurance company owes the restaurant owners coverage and improperly issued a denial. The lawsuit is not seeking additional damages.

Gould expressed concern over the fact that the company, which provides product sterilization services for medical devices, would not acknowledge in court that ethylene oxide is a class one carcinogen and causes cancer. Furthermore, Gould discusses how alternative, safer methods for sterilizing medical equipment exist without the use of ethylene oxide.
