Stop and Frisk Class Action Lawsuit Filed Against City of Chicago and Chicago Police Department to Move Forward

CHICAGO, IL – (November 10, 2015) The motion to dismiss a class action civil lawsuit against the City of Chicago and Superintendent McCarthy for the practice and policy of unconstitutional stop and frisks by the Chicago Police Department (CPD) of City of Chicago residents, including plaintiffs, has been denied according to an opinion issued yesterday by the Honorable Judge Amy J. St. Eve. Personal injury law firm, Romanucci & Blandin, LLC, filed the class action civil lawsuit in April of 2015.

“We are pleased with the court’s decision to allow our civil class action lawsuit to proceed against both the City of Chicago and Superintendent McCarthy,” said Antonio Romanucci, lead attorney for Romanucci & Blandin. “Protecting the constitutional rights of all of our citizens is paramount to the health of this country and to the City of Chicago.”

The class action lawsuit includes 33 named African-American and Hispanic plaintiffs against the City of Chicago and Chicago Police Department. The case alleges that the street stop practice is being done without reasonable articulable suspicion which is required under the Fourth Amendment of the United States Constitution. Instead, the CPD employs race and/or national origin as determinative factors in deciding to stop and frisk individuals, in violation of the Fourteenth Amendment. All victims and plaintiffs represented in the complaint are AfricanAmerican or Hispanic males who seek immediate injunctive and declaratory relief for these unconstitutional “drag net” stop and frisk practices.
