Skilled Surgical Malpractice Lawyers: Seeking Justice for Victims
When you go to the doctor to have surgery, you are placing great trust in the doctor and the hospital. You trust that the doctor will correctly diagnose you and then follow through with the proper course of treatment by a team of medical professionals that includes surgeons and anesthesiologists. Unfortunately, there are a quarter of a million people are killed by surgery malpractice through surgical mistakes or surgical errors each year, according to a study by CNN Health.
A surgical procedure for you or a loved one can be intimidating, but that’s why qualified and responsible healthcare providers and proper oversight by a hospital or medical center are critical.
Your surgical and anesthesia error claim
There are a variety of types of surgical and anesthesia errors that can occur, and the most common types include:
- Doctors treating the wrong patient
- Doctors performing a wrong site surgery on the wrong body part
- Healthcare professionals leaving surgical instruments or materials like sponges inside a patient after surgery
- Patients waking up during surgery because of anesthesia errors
- Doctors failing to provide informed consent regarding the risks of surgery
Another type of shocking medical malpractice case is when doctors - who are trusted by their patients - perform experimental or unnecessary surgeries without their patient’s full consent or understanding. While this seems unthinkable, it does happen.
In fact, the law firm of Romanucci & Blandin is proud to have secured a $30 million personal injury and surgical error settlement for an Illinois family whose young son endured 25 experimental surgeries and was critically injured and left disabled for life as a result of surgery malpractice and medical errors by Mark J. Holterman, MD, who was employed at a major Chicago-area teaching hospital and failed to provide the accepted standard of care. The infant had a non-life-threatening, easily correctable condition called esophageal atresia. The day after the baby’s birth, Dr. Holterman performed what is typically a routine surgery to repair the condition. Following the procedure, Dr. Holterman failed to exercise due care and began a series of 24 experimental procedures on the child that were not authorized by the hospital and were not pursuant to the clinical trial protocol. The final surgery culminated in an inappropriate, off-label use of an endoclose needle that severed the child’s pulmonary artery, resulting in a profound, irreversible brain injury, cerebral palsy and other serious injuries.
This lawsuit by our medical malpractice lawyers was the largest settlement for a child born with esophageal atresia in Illinois and the fourth largest medical malpractice suit of a minor in Illinois.
Surgical errors can result in permanent or life-changing conditions for injured patients including nerve damage, change or damage to a part of the body, brain damage or even wrongful death.
